Expõe, primeiramente, a suposta transição do conceito de interpretação normativa, passando de um formalismo-normativismo restritivo para um realismo jurídico a partir das suas últimas obras; em um segundo momento apresenta o decorrente conflito ainda atual constituído por essas reformulações.
